Welcome to Proxima. By accessing our website at https://www.proximamcp.in or downloading and using our local software application (Proxima), you agree to be bound by these Terms of Service. If you do not agree, please do not use our services or application.

1. Licensing & Use Restrictions

The Proxima application is licensed under the Proxima Personal Use License. You are granted a limited, non-exclusive, non-transferable license to run the software on personal devices for non-commercial development purposes.

• Personal Use Only: Any commercial, enterprise, or institutional deployment of the application is strictly prohibited without acquiring an official commercial license from the author.
• No Redistribution: You may not modify, decompile, distribute, resell, or sublicense the Proxima core packaging files or binaries.

2. Session Routing Disclaimer

Proxima features a "Session Mode" that allows routing local prompts to third-party web-based platforms (such as ChatGPT, Claude, Gemini, and Perplexity) via automated sandboxed browser processes.

• User Responsibility: Session Mode leverages cookies and session tokens from your active, logged-in browser accounts. Automated interaction with these services may be subject to the respective platforms' Terms of Service or programmatic access limits. Use of Session Mode is at your own discretion and risk.
• Official APIs Recommendation: For production, commercial, or high-volume workflows, we strongly recommend switching to BYOK (Bring Your Own Key) Mode using official, authorized developer keys from the providers.

3. Autonomous Agent & Code Modifications

The Proxima Agent is designed to run self-healing development loops, which include analyzing source files, creating patches, and running tests automatically on your workspace.

• Safety Gates: The agent includes safety configurations (Smart and Suggest modes) to halt execution and request your approval before running high-risk commands or modifying code files.
• No Liability: Proxima and its developers are not liable for any data loss, code corruption, system crashes, or security vulnerabilities caused by code modifications or terminal commands executed by the autonomous agent runtime. Always run agents on git-tracked codebases with active version control backup.

4. Website Content & Ads

All materials on our landing page and documentation portal are provided for educational and onboarding purposes. We partner with advertising services (such as Google AdSense) to display programmatic advertisements. We are not responsible for the products, statements, or policies of third-party advertisements served on our site.

5. Disclaimer of Warranties

Proxima is provided "as is" and "as available", without warranty of any kind, express or implied. We do not guarantee that the software will be error-free, uninterrupted, or fully compatible with future API modifications made by third-party model providers.

6. Limitation of Liability

In no event shall Proxima or its author be liable for any direct, indirect, incidental, special, or consequential damages (including, but not limited to, loss of data, loss of profits, or business interruption) arising out of the use or inability to use the software or website.

7. Governing Law

These Terms shall be governed by and construed in accordance with local laws, without regard to conflict of law principles.
